The Nigerian Judiciary changed drastically from an autonomous government following British Common Law to a military deformed Judicial system where the government has suspended Judicial Review and the Executive Branch takes too much part in the Judiciary to have a complete separation of powers. This, therefore, brings about the theory that judges are not well versed in the decisions necessary for their job. The Judiciary's job is to interpret laws in according with constitution. This makes it technically true that Judicial Review exists in Nigeria. There are different levels of courts in Nigeria, the Supreme Court being the highest level. Rule of Law does not exist very much in Nigeria. The government may have a law in the country, but this does not mean the government follows it because of the large amount of corruption that the government deals with. Nigeria derived from English Common Law. Nigeria has a lot of religious law, due to the sharia, which are Islamic courts functioning in the 12 Islamic states. |
